This book, The Hudud, scrupulously examines all aspects of hudud and presents a clear understanding of their realities. It clears up the chaotic mass of odd conceptions about their nature, raison d'etre, immutability, and implementation.
The book also critically examines the rejection of women's testimonies in hudud and other crimes and calls for a new understanding. Generalizing the rule that two women's testimonies are only equivalent to one man's testimony is lacking in clear-cut textual and rational proof. Rejection of non-Muslim's testimonies (in other than zina committed by Muslim partners) is critically reassessed and found to be baseless.
Furthermore, this book deals with all aspects of hudud punishments: medical fitness of the convict, forgiveness and intercession, effects of repentance on hudud punishments, and the applicability of the hudud to Muslims, non-Muslims, visitors to an Islamic state, and to citizens of such a state who commit such crimes abroad.
This book has a corresponding book in Arabic, simultaneously written by the same author. The two volumes carry the same views.
Dr. Muhammad 'Ata Alsid Sidahmad is Professor of Islamic Law at the International Islamic University, Malaysia, where he has been teaching various Shari'ah subjects since 1986. He holds an LL.B (Law) and LL.B (Shari'ah) from the University of Khartoum, Sudan; an M.A. and Ph.D from Temple University in Philadelphia, U.S.A. He has taught Law, Islamic law, Islamic banking, Islamic thought and philosophy in the United States, Sudan, Nigeria, Cyprus and Malaysia. Dr. Muhammad 'Ata Alsid Sidahmad was the founding Dean of the Faculty of Law, Bayero University Kano, Nigeria (1978 - 1984) and a member of the Islamic Fiqh Academy of the Organization of the Islamic Conference, Jeddah, (1984 - to date). His contributions are published in the reputable Journal of the Islamic Fiqh Academy and other journals.
